These terms are an agreement between you and Kitocha ("Kitocha", "we", "us"), a technology business based in Windhoek, Namibia. By creating an account, placing an order or using our services you agree to them. If you do not agree, please do not use the services. We are in the process of formally registering our company and will update these terms with our registered details once that is complete.
1. Our services
Kitocha provides domain registration and management, web hosting, business email, cloud and infrastructure services, and related IT services, as described on our website and in your order. We may improve, change or discontinue features, and will give reasonable notice of changes that significantly affect you.
2. Your account
- You must be at least 18 and give us accurate, current information.
- You are responsible for keeping your login details secure and for everything done through your account.
- Tell us promptly if you think your account has been used without your permission.
3. Domain registration
- Registering a domain gives you the right to use it for the registration period, subject to the rules of the relevant registry and of ICANN. Those rules can change and apply to you.
- You confirm that you are entitled to register the name and that doing so does not infringe anyone else's rights.
- The owner details you give must be accurate. False details can lead to suspension or loss of the domain.
- Renewing a domain is your responsibility. We send reminders, but we cannot promise that a domain can be recovered once it has expired.
- Availability shown on our site is indicative until the registry confirms the registration.
4. Hosting and email
- Hosting plans come with the resource limits shown on the plan. Use must be reasonable and must not harm other customers or our systems.
- You are responsible for your content and for keeping your own backups of anything important.
- We work to keep services available but cannot guarantee they will be uninterrupted or error-free.
5. Prices and payment
- Prices are shown in Namibian Dollars (N$). Taxes such as VAT are stated at checkout or on your invoice where they apply.
- Payment is by EFT / bank transfer. Services start once payment has been received and cleared.
- Domains and hosting renew at the renewal price in force at the time unless you cancel before the renewal date.
- If an invoice is overdue we may suspend the related services until it is paid.
6. Cancellations and refunds
You can cancel a service at any time. Domain registrations, transfers and renewals cannot normally be refunded once they have been submitted to the registry, because those fees cannot be recovered. For hosting and other services, contact us at support@kitocha.com and we will look at your situation fairly and in line with the law.
7. Acceptable use
You must not use our services to send spam, spread malware, host unlawful or infringing content, run phishing or fraud, attack other systems, or interfere with the service or with other customers. We may suspend or remove content or services that break this section or the law, and will tell you why where we reasonably can.
8. Intellectual property
You keep ownership of your content and give us the limited right to host and process it so we can deliver the services. Kitocha's name, logo and website remain ours.
9. Limits on our liability
As far as the law allows, we are not responsible for indirect or consequential loss, lost profit or lost data, and our total liability for any claim is limited to the fees you paid us for the affected service in the 12 months before the claim. Nothing in these terms limits liability that cannot lawfully be limited.
10. Suspension and ending the agreement
You can close your account at any time. We may suspend or end services if you break these terms, do not pay, or if a registry or the law requires it. Refunds, if any, are handled under section 6.
11. Privacy
How we handle personal information is explained in our Privacy Policy.
12. Changes to these terms
We may update these terms, including when our company registration is complete. The date at the top shows when they were last changed, and we will email account holders about significant changes. Using the services after a change takes effect means you accept it.
13. Governing law
These terms are governed by the laws of Namibia, and the Namibian courts can hear any dispute, unless mandatory consumer law in your own country says otherwise.
